Serdar Baskin is the president and the founder of TRADE REMEDIES CONSULTING. His practice focuses on international trade cases and trade policy issues.  He represents clients in a wide range of cases covering antidumping (price discrimination), countervailing duties (subsidies), safeguards, and anti-circumvention issues. He also advises clients on trade policy and legislative matters, as well as trade negotiations such as those involving the WTO and international anti-subsidy agreements.

Mr.Baskin is a long-time practitioner with vast experience in trade remedies in various sectors. He is the most experienced consultant on trade remedies in Turkey. He started his career as a case handler in anti-dumping investigations in 1995 in the investigating authority of Turkey. He actively participated in the amendment process of the Law, Decree and Regulation of Prevention of Unfair Competition in Imports of Turkey for being in line with the Anti-Dumping Agreement and Subsidies and Countervailing Measures Agreement of the WTO.

He worked as a case handler between 1995 and 2002, and as a Chief of Anti-Dumping and Countervailing Duty Investigation Department between 2004 and 2009, and between 2013 and 2014 in the Ministry of Economy. While with the Turkish investigating  authority Mr. Baskin participated, from initiation to conclusion, in more than one hundred anti-dumping investigations, more than ten anti-circumvention investigations and one countervailing duty investigation.  In these investigations he acted as a member of or head of the investigating team, or as a supervisor of the investigation. He conducted on the spot investigations at the premises of the various domestic producers and at the premises of exporters/producers located in France, Italy, Belgium, China, Chinese Taipei, India, Indonesia, Malaysia, Romania, South Korea and Thailand.

Mr. Baskin has given numerous lectures, workshops, and seminars to chambers of commerce or chambers of industries to inform them about their rights and obligations under applicable anti-dumping, subsidy and safeguard investigation procedures. He also has given workshops and seminars specifically on the calculation of anti-dumping margins and subsidy amounts to the investigating authorities of Ukraine, Azerbaijan, Morocco, and Kazakhstan.
 
Mr. Baskin was a member of the team investigating the unique and successful countervailing duty (anti-subsidy) case against India on PET film in 2008 and 2009. He calculated the subsidy amount for certain cooperatives in India. Today Mr. Baskin is the only consultant in Turkey who is capable of accurately calculating countervailing duties as they would be calculated by the investigating authorities.
 
Mr. Baskin served as a Counsellor at Permanent Mission of Turkey to the World Trade Organization in Geneva between 2009 and 2013. During that time he represented Turkey as a chief negotiator in the Rules Negotiations (Anti-Dumping Agreement, Subsidies and Countervailing Measures Agreement, RTAs, Fisheries Subsidies) and the negotiations of the Dispute Settlement Understanding. He contributed to the rules-based multilateral trading system by serving as one out of three “facilitators” in the Subsidies and Countervailing Agreement negotiations regarding the crucial “best information available annex” to the Subsidies and Countervailing Measures Agreement. In addition to this he led the establishment of the “Friends of Third Parties Group” including Guatemala, Ecuador, Colombia, Chinese Taipei, Switzerland and Turkey. 

Mr.Baskin also took part in the preparation and orally submission of Turkey’s Third Party view in the trade remedies disputes that Turkey participated in as a third party to the WTO panel and Appellate Body. He participated in the preparation of Turkey’s legal view on DS379, DS397, DS399, DS405, DS415-416-417-418, DS436, DS437, DS440, DS442, DS449, DS454, DS460 and its oral submission to the WTO panel and Appellate Body.

Mr. Baskin  represented the Turkish steel nails industry in the anti-dumping and countervailing duty investigation initiated by the U.S. and achieved dismissal of Turkey from that investigation at the U.S. ITC’s preliminary injury review stage in 2014. He represented the Steel Exporters’ Association in the anti-dumping and countervailing duty investigation on "steel rebar" initiated by Canada against Turkey in 2014.

He  represented one of the exporters/producers in anti-dumping and countervailing duty investigation on “rainbow trout” initiated by the European Commission in 2014. He achieved to get the least countervailing duty for his client by decreasing the countervailing duty from 7.1% to 6.7%.

He also represented “Cargill Cotton Business Unit” in 2015-2016, Cargill Incorporated in the anti-dumping investigation on “upland cotton” initiated by Turkey originating in the USA  and received theleast dumping margin for Cargill.

He represented “China Chamber of Commerce for Import and Export of Machinery and Electronic Products” in the safeguard investigation on “mobile phones” initiated by Turkey and succeeded termination of the investigation without measure in 2015.

He represented 3 exporting producers selected in sampling in the “sea bass” and “sea bream” subsidy investigation and the Aegean Exporters’ Association initiated by the European Commission against Turkey in 2015. This investigation was also terminated without measure as a solid injurydefence.

He represented SunFlag and Indorama in the “polyester textured yarn” anti-dumping investigation from Thailand between 2014-2016 and received the least anti-dumping duty for its client by decresaing the margin of SunFlag from 8,33% to 6,88% after the Final Disclosure.

He also represented “China Chamber of Commerce for Import and Export of Machinery and Electronic Products” and “Canadian Solar Group” from China with regard to solar panel AD investigation initiated by Turkey in 2016.

He also represented “Shanxi Taigang Stainless Steel Co., Ltd. (TISCO)” from China and “Chia Far” from Chinese Taipei in the anti-dumpin investigation on “cold  rolled stainless steel sheet/coil” and achieved termination of the investigation without measure due to solid injury defence in 2017.

In 2017, Mr. Baskin achieved initiation partial interim review investigation on “rainbow trout” countervailing duty in force by the applicaton to the European Commission and he represented the Aegean Exporters’ Association and 4 out of 6 sampled exporting producers in this investigation process.  This investigation was terminated.

In 2017 and 2018 he also represented  Ilim Group from Russia and Mondi Group from Poland in kraftliner paper AD investigation initiated by Turkey. He achieved decrease of anti-dumping margin from 16,12% to 5,0% for Mondi Group and from 11,42% to 5,28% for Ilim Group after the publication of the Final Disclosure.

He also represented Huvis Corporation from Korea in polyester staple synthectic fiber AD expiry review investigation initiated by Turkey. The duty rate was maintained as in the original investigation as aresult of this inevstigation.

He has represented, the biggest exporter/producer Hanwha Chemicals from Korea and Korean Petrochemical Industry Association in PTA AD investigation initiated by Turkey and with his successful defence on injury this investigation has been terminated without measure.

He also represented the only Turkish producer Eti Elektrometalurji A.Ş. in “lowcarbon ferro-chrome” AD investigation initiated by the European Commission in 2018 against Turkey and achived termination of this investigation without measure as a result of solid injury defence.

He represented Taekwang Industrial Co., Ltd. form South Korea with in the “acrylic fiber” AD investigation initiated by Turkey in 2018 against, China, Germany, Korea and Thailand and the Government of China within the “acrylic fiber” subsidy investigation initiated by Turkey against China. Both of the investigations were terminated without measure as a result of solid injury defense.  

Mr. Baskin represented certain companies from China, Chinese Taipei and Russian Federation in the safeguard investigation initiated by Turkey on certain steel produts.

In 2019, he achieved initiation of partial interim review investigation as a result of its application to the European Commission on behalf of Kılıç Deniz which has the highest countervailing duty rate (9,5% of CIF Value) and achieved initiation of partial interim review investigation. As a result of this investigation, he achieved decrease of the margin from 9,5% to 1,5%. In the final Disclosure of the EU Commission the margin was disclosed as 2,3%, but achieved to decrease to 1,5%.

Mr. Baskın represented Turkish biggest exporting producer, Belenco on “quartz surfece products” within the anti-dumping and subsidy investigation initiated by the US and achieved to decrease its subsidy margin 1,4% to 2,43%. 

He represented 4 largest exporting producers (Osstem, Megagen, Dentium, Cowellmedi) on “dental implants” anti-dumping investigation originating in Korea and achived decrease anti-dumping duty by succeding implementation of lesser duty rule by the investigating authority to 15% which is more than 30%.

He also represented Inox Hoa Binh JSC on the anti-dumping investigation on welded stainless steel tubes, pipes & profiles originating in Vietnam.

He represented two exporting producers within the expiry review countervailing duty investigation on rainbow trout initiated by the EU Commission.

Mr. Baskın has represented all (three) exporting producers within the partial interim review countervailing duty investigation
on rainbow trout initiated by the EU Commission upon its application. He achieved decrease of current counturvailng duty rates of the exporting producers significantly. As a result of this investigation,  Fishark CVD rate decreased from 7,6% to 3,4%,  Özpekler CVD rate decreased from 6,7% to 3,1 % and Gümüşdoğa CVD rate decreased from 6,9% to 4,4%. Mr. Baskin also represented Huvis Corporation from South Korea on polyester flat yarn anti-dumping investigation initiated by Turkey against South Korea. 

Currently, he has been representing two exporting producers namely Fishark and Gümüşdoğa on refund investigation initiated by the European Commission on rainbow trout upon the application. It is notable that it is the first refund investigation initiated against a Turkish company in Turkey’s trade remedy history.  

Mr. Baskin has published two international articles in Volume 1 and Issue 11/12 of “Global Trade and Customs Journal” named “EU and Turkey: Privileged Partner or More?” ve Issue and “Circumvention of Anti-Dumping Measures: Law and Practice of Turkey” respectively.
